This Privacy Notice explains how Mimic Networks, Inc. and its subsidiaries and affiliates (collectively, "Mimic", “our”, “us”, or “we”) collect, use and disclose personal data about you when you use our websites or interact with our social media channels, and/or receive our newsletters or emails (collectively, the "Mimic Content").

By using the Mimic Content, you acknowledge you have read and accept this Privacy Notice.

The Mimic Content is intended for general audiences, and we do not knowingly collect personal data from minors under 13 years of age.

Mimic may obtain information about you from your interaction with our Mimic Content.

We collect personal data that you provide to us when you interact with the Mimic Content, including the following:

  • Contact or identifier data when you sign up for Mimic Content, such as your name, postal address (including billing and shipping address), email address, telephone or mobile phone number;

We gather by automated means (such as cookies, web beacons, web server logs and similar technologies) certain information through the Mimic Content. Such data may include:

  • Device information, such as unique identifier and connection information, including mobile device advertising IDs (e.g., Apple IDFA or Google AAID);
  • Your device type and settings, software used, browser type and operating system;
  • Language preferences;
  • Viewing behavior, including the content you view and for how long;
  • Web pages you view and links you click on within, and search queries you may have run on the Mimic Content;
  • Other usage data, such as the websites or other services you visited before visiting the Mimic Content (the referring URL), access times and other details about your use and interactions on our content; and
  • Location information, including the city, state and zip code associated with your IP address.

3. HOW WE USE THE DATA WE OBTAIN

We may use the personal data we collect from and about you for the purposes set forth below.

3.1 To Provide and Manage the Mimic Content

This may include to:

  • Providing our content to you;
  • Providing customer support, including via online chat or chat bot, and to respond to inquiries you make;
  • Delivering relevant content and suggestions (e.g., we may use your reading history or activity to personalize the content delivered to you across Mimic Content);
  • To improve our Mimic Content, products and services
  • To operate, evaluate and improve our business (including analyzing, developing, enhancing, and improving our content, products and services; managing our communications, performing data and statistical analytics, and performing accounting, auditing and other internal functions); and
  • To monitor and analyze the extent of your use of the Mimic Content, to inform modifications, enhancements, or updates to the Mimic Content, or to make marketing decisions.

3.2 To Protect the Rights of Mimic and Others

Mimic may use your personal data as we believe to be necessary or appropriate in order to:

  • Protect against, identify theft, fraud and other unlawful activity, claims and other liabilities;
  • Secure, protect and defend the privacy, safety or property of the Mimic Content, our employees and agents, or users;
  • Comply with and enforce legal requirements, including laws outside your country of residence, relevant industry standards, contractual obligations, and our terms of use and other policies; and
  • Respond to inquiries from third parties, including inquiries from law enforcement authorities.

We may combine information we obtain about you for the purposes identified in this Section 3.

4.1 Our Service Providers

We may share some or all of your personal data identified above, as necessary for the specific services, with our service providers, who provide services to us or to you on our behalf (e.g., sending email, or improving or customizing the Mimic Content, hosting our website). These third party service providers are not authorized to use your personal data for any other purpose than the specific service they are providing to us or to you on our behalf.

4.2 With Social Networking Services

We may share your information when you log into or connect a social media service account with the Mimic Content. The Services may also offer you the ability to share information to a social networking site (e.g., LinkedIn,), by using integrated tools (e.g., LinkedIn “Like” button). To control this sharing of information, please review and adjust your privacy settings for the relevant social network. The social networking service's use of the shared information will be governed by its privacy notice.

4.3 For Legal Requirements and Proceedings

We may disclose your personal data to law enforcement authorities or other government officials if we are required to do so to comply with subpoenas, court orders, legal process or other government measures, and to comply with other legal obligations. We may also disclose information if we believe disclosure is necessary or appropriate in connection with an investigation of suspected or actual fraud or illegal activity.

We may disclose your personal data to protect and defend the rights, interests and safety of the content services and our users, Mimic, and our employees, contractors and agents; and to protect the security of our content services, including when we believe it is necessary or appropriate to prevent physical harm or financial loss.

5.1 Your Choices

We offer you many choices and you may have certain rights in connection with the personal data we collect about you.

5.1.1 Email Communications

If you connect to us through our published email addresses, we may use your email address for automated marketing purposes without your permission, additionally by contacting us through our published email addresses you are consenting to our use of your email address to respond to you.

5.1.2 Cookies

We may collect information through the use of cookies.The information we obtain through the use of cookies may include information about your computer, device, and browser, such as your IP address, browser, operating system, device characteristics, language preferences, mobile device or advertising ID, and referring URLs.We use cookies to improve the user experience and improve our content delivery. Cookies can recognize you and remember important information that will make your use of our website more convenient.

We use information we obtain through the use of cookies to enhance our products and services, for example by learning which content is popular.

5.1.3 Browser Controls

You have choices about whether cookies or similar technologies are placed on your computer or mobile device.

5.2 Your Rights

Subject to applicable law, you may have certain rights to access, review, update, correct inaccuracies in or delete your personal data which is in our possession by submitting a request to privacy@mimic.com.

For certain types of requests, we may also need to ask you for additional information to verify your identity. Once we have verified your identity, we will respond to your request as appropriate.

In the event you have provided your consent for our use of your personal data, you have the right to withdraw your consent and we will apply your preferences going forward.

Mimic uses a combination of administrative and technical measures to safeguard personal data in its possession against accidental, unlawful or unauthorized loss, use, access, disclosure or modification. We use commercially reasonable efforts to ensure a level of security that is appropriate to the risk of any processing of your personal data, taking into account the costs of implementation and nature of the processing of personal data. This is not a guarantee of complete safety of your personal information.

7. OTHER IMPORTANT INFORMATION

7.1 Transfers of Personal Data

Your personal data may be stored, transferred to, and processed in any country where we have facilities or in which we engage service providers. These countries may be outside your country of residence, including the United States, and may have different data protection laws than in the country in which you initially provided the data. Applicable laws in the United States and/or other countries may allow the courts, law enforcement and national security authorities to access your personal data when in such countries.

If you are a user located outside the United States or the country to which your information may be transferred, you understand (and, as permitted under applicable law, consent to having any personal data processed in the United States or such country. When we transfer your data, we will protect that data as described in this Privacy Notice.

7.2 Links to Affiliates and Third Party Sites or Apps

The Mimic Content may also be linked to sites or apps operated by third parties, and may carry advertisements or offer content, special offers, functionality, games or applications developed and maintained by third parties, using iframes, tools, or plug-ins.

Mimic is not responsible for the privacy practices of such third parties, please check the respective third party service for their privacy notice.

7.3 Updates to Our Privacy Notice

Mimic may periodically update this Privacy Notice without prior notice to reflect changes in our privacy practices and the Mimic Content. If we modify the Privacy Notice, we will update the Effective Date and the changes will become effective as of the date we post such Privacy Notice.
